Council of the Pharmaceutical Society of Ireland – v – Savage Scripts Limited trading as Leighlin Pharmacy, St Lazerian’s Street, Leighlinbridge, Co. Carlow (Retail Pharmacy Business 6608) on 07 September 2017

The pharmacy was convicted of:
(i) Selling or supplying prescription only medicines and non-prescription medicines without the personal supervision of a registered pharmacist, contrary to section 28(c) and section 26(2) of the Pharmacy Act 2007.
(ii) Failing to keep the Controlled Drugs Register in accordance with the requirements of the Misuse of Drugs Regulations, contrary to regulation 12(1)(b) of the Regulation of Retail Pharmacy Businesses Regulations 2008 S.I. 488 of 2008.

Outcome
The pharmacy pleaded guilty to five charges. The court recorded convictions in respect of two charges and the remaining three charges were taken into account when deciding the appropriate sentence and form part of the overall conviction. The pharmacy was fined €6,000 and costs of €5,000 were awarded to the PSI.

Council of the Pharmaceutical Society of Ireland – v – Widdess Fitzgibbon Pharmacy Limited trading as Widdess Fitzgibbon Pharmacy Limited, 55 Roches Street, Limerick, Co. Limerick (Retail Pharmacy Business 5870) on 03 March 2017

The pharmacy was convicted of:
(i) Failing to keep the veterinary register over a period of time, contrary to regulation 13 of the Regulation of Retail Pharmacy Businesses Regulations S.I. 488 of 2008.
(ii) Supplying veterinary prescription only medicines in the absence of a prescription over a period of time, contrary to regulation 11 of the Regulation of Retail Pharmacy Businesses Regulations S.I. 488 of 2008.

Outcome
The pharmacy pleaded guilty to three charges. They were convicted on the three charges and fined €500 per charge. The pharmacy agreed to pay a contribution of €3000 to the PSI’s costs.

Council of the Pharmaceutical Society of Ireland - v - Denis Finnerty trading as Mocklers Pharmacy (Retail Pharmacy Business 5648), Patrick Street, Templemore, Co. Tipperary on 09 March 2016

The pharmacy was convicted of selling or supplying prescription only medicines without the personal supervision of a registered pharmacist, contrary to section 27(d) and section 26(2) of the Pharmacy Act 2007.

The pharmacy was fined €3,000 and costs of €2,000 were awarded to the PSI.
