Michael Mahony and Mahony's Pharmacy Limited

In the matter of Part 6 of the Pharmacy Act

Complainant: The Registrar and Chief Officer of the Pharmaceutical Society of Ireland (“PSI”)

Respondents: Mr Michael Mahony MPSI (Registration No.4416) and Mahony’s Pharmacy Limited t/a Mahony’s Pharmacy (Registration No. 5620)

Following the consideration of a Mediators Report in relation to the mediation of a complaint against Michael Mahony and Mahony’s Pharmacy Ltd. t/a Mahony’s Pharmacy, the Council of the PSI at its meeting on 3 February 2022 censured Mr. Mahony, and noted that in accordance with the Terms of Resolution of the mediation dated 13 December 2021, public notice would be given of the censure and of the following paragraphs of the Terms of Resolution:

  1. Mr. Mahony acknowledges that on 13 November 2019, he should not have:

(a) allowed the pharmacy to open and remain open for a period of time when there was no pharmacist on duty,

(b) allowed pharmacy-only medication to be sold at the pharmacy when there was no pharmacist on duty,

(c) allowed prescription-only medication including a controlled drug to be supplied at the pharmacy when there was no pharmacist on duty,

(d) initially made false statements to an Authorised Officer of the PSI about his presence in the pharmacy in response to questions from the Authorised Officer of the PSI, and further acknowledges that this conduct was a breach of trust, irresponsible and unprofessional.

  1. In recognition of the acknowledgements given in paragraph 1, Mr Mahony apologises and consents to being censured by the Council of the PSI. 
  2. Mr. Mahony undertakes not to repeat his/the conduct as described above and further undertakes to adhere strictly to all legal and professional responsibilities as a pharmacist and superintendent pharmacist. 
  3. Mahony’s Pharmacy Ltd. t/a Mahony’s Pharmacy, apologises and undertakes to ensure that all employees of the pharmacy will strictly adhere to all legal and professional responsibilities as set out in the Pharmacy Act, 2007 (as amended), together with all policy and procedural guidelines provided by the Pharmaceutical Society of Ireland.”
